Terms of Service

This agreement is between you and the team operating Breachly. It applies to the website, the signed in app and the Telegram bot, however you reach them.

You must be at least 18 and legally able to enter a contract. If you are using Breachly for a company, you confirm you are allowed to accept these terms on its behalf, and "you" then means that company.

Breachly searches records that have already been published or circulated elsewhere. You give it an identifier such as an email address, phone number, username or name and it returns the records that match. You can upload a file and run the same lookup over every line, then export the results in the layout you choose.

Two things follow from that, and they matter more than anything else on this page.

• We do not vouch for the data. The records come from third-party sources. They can be incomplete, out of date, mismatched or simply wrong. A result is a lead, not a fact, and it is on you to verify anything you intend to act on.
• This is not a consumer reporting service. Breachly is not a consumer reporting agency and its results are not consumer reports. You may not use them to decide anything about credit, employment, insurance, housing, tenancy or any other purpose covered by consumer reporting law in your country.

• An account belongs to one person or one company. Sharing credentials, reselling access or letting others search on your account is not allowed.
• You are responsible for what happens under your account. Keep your password to yourself and use a strong one.
• Every signed in session appears in your profile with the device it belongs to. If you see one you do not recognise, end it and change your password.
• You can hold an account on the site, through Telegram, or both. Linking Telegram is optional, and you can disconnect it yourself from the Telegram page in your account.
• A disconnect starts a waiting period. For about two weeks afterwards no Telegram account can be connected to yours, including the one that was just removed, so disconnect only when you mean it. If Telegram is the only way you sign in, the disconnect is not offered until you set a username and a password, so it can never leave you with no way back in.
• Tell us straight away if you think someone else has access to your account.

You are responsible for having a lawful reason for every search you run and every line of every file you upload. The following are never allowed and will end your account.

• Stalking, harassing, threatening, doxxing or intimidating anyone.
• Identity theft, fraud, extortion, phishing or any attempt to gain unauthorised access to an account or system.
• Any decision about credit, employment, insurance, housing or tenancy.
• Discrimination against anyone, or any use that breaks data protection, privacy or consumer protection law where you are.
• Reselling, republishing or redistributing results, or building a competing service or dataset from them.
• Scripting, scraping or automating against the service outside the features we provide, or working around plan limits.
• Probing, load testing, reverse engineering or interfering with the service or anyone else using it.
• Uploading identifiers you have no right to process.

• Each plan carries its own allowances, and the app always shows what you have used, what is left and when it resets.
• Reaching an allowance pauses further searching on that type until the next reset. It does not end your plan and it does not cost you anything.
• Your plan also sets how many unfinished bulk jobs you can hold at once. At the cap, a new one is refused until you finish or remove one of the others. Nothing is queued behind it.
• Allowances are personal to your account. Pooling them across accounts, or passing searches through on behalf of others, is a breach of these terms.
• We may change what a plan includes. If a change reduces what you already paid for, it applies from your next term, not the one you are in.

• Cryptocurrency only. We take Bitcoin, Ethereum, Litecoin, Tether and Monero through our payment provider. We do not accept cards and we never hold your wallet or your keys.
• Prices are shown in US dollars. The amount of coin you send is worked out at the time the invoice is created and is fixed for that invoice.
• An invoice expires. If you do not pay it in time it simply lapses, you owe nothing, and you can start a new one whenever you like.
• Access starts on confirmation. Your plan activates once the network confirms the payment, which is usually minutes. Network fees are yours.
• Send the right amount on the right network. An invoice is tied to one coin and one network. Sending a different coin, or the right coin on the wrong network, can put the funds beyond anyone's reach, including ours. If that happens, open a ticket and we will help where we technically can, but we cannot promise recovery.

• Nothing renews by itself. There is no stored payment method and no recurring charge anywhere in the system. Your plan runs for the term you bought and then stops. You will never be charged again without starting a new order yourself.
• Terms are monthly, annual or lifetime. A lifetime purchase is a single payment for continued access while the service operates.
• Renew whenever you like. Your subscription page shows the exact end date and how much of the term is left.
• Redeem keys. A key applied while a plan is still running adds its time to your existing end date rather than replacing it. A key can only be used once.
• When a term ends. Searching stops. Your account, your saved formats and your history stay where they are, and buying a new term brings everything back.

Please read this before you pay. Crypto payments settle on public networks and cannot be pulled back by us once they confirm.

• An unpaid or expired invoice costs you nothing. There is nothing to refund.
• Once a plan is active, the term is not refundable, in whole or in part, and unused allowance has no cash value.
• If you paid and did not get what you paid for, that is on us. Open a ticket and we will either fix it or refund it.
• If we end your account for breaking these terms, the remaining term is not refunded.
• None of this takes away a right you have under the mandatory consumer law where you live.

• The file you upload stays yours. You give us permission to process it in memory, only to run your job, and nothing else. We never read its contents, and no one on our team can see the results a job returns.
• You confirm you have a lawful basis to process every identifier in it.
• A job you start and never finish stops being resumable 24 hours after you last worked on it. It leaves your active jobs and stays in your history until you remove it.
• Your uploaded file and your results are held only for your active session. The file is processed in memory and removed from our servers once the session ends; your results live in memory for that session and are never stored in our database. Only an export you deliberately build is written to disk, so you can download it.
• A download link for an export is good for a short window and one download. If it lapses, build the export again from the job.
• Keep your own copy of anything you need long term. We are not a storage service, we do not promise to hold your exports, and we may clear old files with notice.

How all of this is handled is set out in the privacy policy, which forms part of these terms.

• We aim to keep Breachly available around the clock, but no service is available every second and we do not promise that it will be.
• Maintenance happens. Where we can plan it, we announce it first.
• Features can change, and sources can be added or removed as their availability changes.
• The status page shows how each part of the service is doing right now.

• You can stop using Breachly at any time, and you can ask us to delete your account from the contact page.
• We can suspend or close an account that breaks these terms, that is used for anything in the acceptable use section, or where we are required to by law.
• Where the problem is minor and fixable, we will normally warn you first. Where it is serious, we will not.
• Closing an account does not cancel anything either side already owes, and the disclaimers and liability limits below survive it.

The Breachly name, the interface, the software behind it and everything we publish belong to us. Your plan gives you a personal, non-transferable right to use the service while it is active, and nothing more. What you upload and what you export stay yours.

Breachly is provided as it is. To the fullest extent the law allows, we give no warranty that results will be accurate, complete, current or fit for any particular purpose.

• We are not liable for indirect, incidental or consequential loss, for lost profit, or for anything you decided to do on the strength of a result.
• Our total liability to you, for everything combined, is limited to what you paid us in the 12 months before the claim.
• You are responsible for how you use the service, and you will cover us against claims brought by others arising from your use of it.
• Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

We can update these terms. When we do, the date at the top changes and, if the change is significant, you will see it in the app before it takes effect. Continuing to use Breachly after that means you accept the new version. If you do not, stop using the service and ask us to close your account.

These terms, and any dispute arising out of them or out of your use of Breachly, are governed by the law of the country in which Breachly is established, without regard to its conflict of law rules. The courts of that country have jurisdiction.

If you are a consumer, this does not remove any protection you have under the mandatory law of the country you live in, and it does not stop you bringing a claim there.
